In the legal action “K.G.M. v. Platforms et al.,” currently proceeding in L.A. County’s Superior Court, a panel of jurors will determine whether social media companies are accountable for adolescent psychological problems stemming from their platforms or their habit-forming designs. Snap and TikTok reached an agreement prior to the trial’s commencement, but Meta and YouTube refused. Executives from both corporations will provide sworn statements as a component of the trial.

The 19-year-old complainant in this matter, identified by the initials K.G.M. or “Kaley,” asserts that early exposure to social media adversely affected her psychological well-being, causing her to form a dependency on the technology and suffer from despondency, encompassing suicidal ideation.

Meta contests the notion that its app is responsible for Kaley’s difficulties.

“The central inquiry for the jury in Los Angeles is whether Instagram was a significant contributor to the plaintiff’s psychological challenges. The presented facts will demonstrate she encountered numerous weighty, arduous obstacles long before she ever used social media,” said Meta spokesperson Stephanie Otway in a written communication concerning the proceedings.

Counsel representing the claimants aim to demonstrate that Meta established internal objectives to boost user engagement duration on Instagram, even though they were aware of underage individuals on the service. In Zuckerberg’s deposition this month, he faced scrutiny regarding his declaration to Congress in 2024 that children under 13 were prohibited from using Instagram, when corporate records indicated the firm was cognizant of approximately 4 million youngsters under 13 on the app back in 2015. The record additionally pointed out this figure constituted 30% of all 10-12-year-olds in the U.S.

A further electronic mail, composed by Zuckerberg advisor Nick Clegg, who departed the firm in the previous year, highlighted that Instagram’s stipulations for user age were essentially “impractical to uphold.”

Even with the awareness of minor users on its service, Instagram failed to act regarding its current minor users until August 2021, a point at which it commenced mandating users provide their dates of birth, the plaintiff’s lawyers contended.
